The terms that apply when you use this site or place an order with ProEfficient Fitness.
These Terms of Service govern your use of proefficientfitness.com and any purchase made through it. By accessing this site or placing an order, you agree to these terms. If you do not agree, please do not use the site.
ProEfficient Fitness is operated from 1875 Mission St Ste 103, San Francisco, California 94103.
You must be at least 18 years old to place an order. By purchasing, you confirm that you are 18 or older and legally able to enter into this agreement.
We make every effort to display products and pricing accurately. Product images are provided by manufacturers and are for illustration — actual appearance, colour and finish may vary.
Prices are in U.S. dollars and may change without notice. We reserve the right to correct pricing or product description errors, including after an order has been placed. If a correction affects your order, we will contact you before proceeding and you may cancel for a full refund.
Your order is an offer to purchase. We reserve the right to accept, decline or limit any order, including where a product is unavailable, a pricing error has occurred, or we are unable to verify payment or delivery details.
Product availability depends on manufacturer stock and may change after an order is placed. If an item becomes unavailable, we will contact you to arrange a substitution, backorder or refund.
Payment is due in full at the time of order unless otherwise agreed in writing. We accept payments through SharkPay and any other payment methods shown at checkout. You confirm that you are authorized to use the payment method provided.
Applicable sales tax is calculated at checkout.
Shipping terms are set out in our Shipping Policy. Returns and refunds are governed by our Return & Refund Policy. Both form part of these terms.
Unless purchased as a separate service, assembly and installation are the customer’s responsibility. Equipment must be assembled and installed according to the manufacturer’s instructions.
Fitness equipment carries inherent risks. Consult a physician before beginning any exercise programme. Follow all manufacturer instructions, weight limits and safety warnings. Inspect equipment regularly and do not use damaged or improperly assembled equipment.
ProEfficient Fitness is not responsible for injury, property damage or loss resulting from improper assembly, installation, use or maintenance of equipment.
Products are covered by the applicable manufacturer’s warranty. Warranty terms and duration vary by brand and product. ProEfficient Fitness does not provide its own warranty beyond the manufacturer’s, but will coordinate warranty claims with the supplier on your behalf.
Except as expressly stated, products are provided “as is” without warranties of any kind, express or implied, to the fullest extent permitted by law.
To the maximum extent permitted by law, ProEfficient Fitness shall not be liable for any indirect, incidental, special or consequential damages arising from the use of this site or any product purchased through it.
Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.
All content on this site, including text, layout, graphics and the ProEfficient Fitness name and logo, is our property or used with permission, and may not be reproduced without written consent. Manufacturer brand names, logos and product images remain the property of their respective owners.
You agree not to use this site for any unlawful purpose, to interfere with its operation or security, to submit false information, to use automated systems to scrape or copy content, or to resell products purchased here without our written consent.
This site may link to third-party websites. We are not responsible for the content, accuracy or practices of those sites.
You agree to indemnify and hold harmless ProEfficient Fitness, its owner and its suppliers from any claim or demand arising from your breach of these terms or your misuse of any product.
These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute shall be resolved in the state or federal courts located in San Francisco County, California.
We may update these terms at any time. The version posted on this page at the time of your order applies to that order.
